David Kritzer, Founder
David S. Kritzer is the founder of the firm. Mr. Kritzer practices in all areas of tort defense litigation with a particular emphasis in the defense of motor vehicle, premises liability and trucking and transportation law cases.
Before forming the Law Offices of David S. Kritzer & Associates, P.C., Mr. Kritzer was employed for over eight years as the managing attorney and senior trial attorney with the Law Offices of Mitchell N. Kay. Mr. Kritzer then founded the Law Offices of David S. Kritzer & Associates, P.C. where he obtained numerous appointments as outside trial counsel to various entities such as the New York City Metropolitan Transportation Authority, New York City Transit Authority, Long Island Railroad and Metro-North Railroad.
Mr. Kritzer has experience in commercial and corporate litigation and also practices in the area of real estate.

Mr. Kritzer has extensive trial and appellate practice experience and has successfully petitioned for, drafted, and argued appeals in the New York State Court of Appeals which resulted in a landmark decision concerning Long-Arm Jurisdiction. He has represented a wide variety of individuals, businesses, corporations, municipalities, insurance companies, self-insured entities, third-party administrators, and risk adjustment companies in all phases of plaintiff and defense litigation from case inception through trial and appeal. He has obtained many favorable verdicts on high exposure cases and has lectured on numerous insurance-related topics.
Mr. Kritzer has also served as a federal court-appointed mediator on civil cases in the United States District Court for the Eastern District of New York as well as serving as an independent mediator in cases at the state and local levels. In addition, Mr. Kritzer has tried Federal and Supreme Court cases to verdict in most counties in the metropolitan area.
Mr. Kritzer is a member of the American Bar Association, New York State Bar Association, the American Trial Lawyers’ Association, the Suffolk Trial Lawyers’ Association, National Retail and Restaurant Defense Association, DRI, and the Claims and Litigation Management Alliance where he serves as a member of the Transportation Committee. He is also a member of the Board of Directors for the Dominican Village, a retirement and assisted living facility. He has also been recognized by Marquis Who’s Who in America, Lawyers of Distinction for Excellence in Insurance Law, and by Super Lawyers for his work in the Insurance Defense industry.
Mr. Kritzer was admitted to practice in New York State in 1992 and was admitted to the United States District Court for the Eastern District of New York in 1993.
Mr. Kritzer received his Juris Doctor Degree from New York Law School in 1992, and his Bachelor of Science in Accounting and Finance from SUNY Buffalo in 1989.
Mr. Kritzer resides with his wife and four children in Smithtown, New York. In his free time, he enjoys spending time with his family including traveling, cycling, golfing, and skiing.
Donna Prox, Associate Attorney
Donna K. Prox has been an Associate with Kritzer Law Group since 2012. Ms. Prox has successfully defended automobile and premises liability matters for the firm from inception to trial including drafting dispositive motions and appeals. She also appears in State and City Courts throughout the greater New York City area on a wide variety of matters.
Having begun her career at the Administration for Children’s Services, Ms. Prox prosecuted child abuse and neglect petitions on behalf of the Commissioner for Social Services of the City of New York. She furthered her career by later joining a Brooklyn civil defense firm where she handled all aspects of automobile negligence defense from inception through trial.
Ms. Prox earned a Bachelor Degree in Political Science from Kent State University in 1996. She graduated from the City University of New York School of Law in 2000. In her free time, she enjoys music, cooking and traveling.
Karl Zamurs, Associate Attorney
Karl Zamurs received his Juris Doctor degree from St. John’s University in 1982. He was admitted to practice in the State of New York in May 1983 and In the Eastern and Southern Districts of New York in 1984.
Mr. Zamurs began his career by becoming an associate in the firm of Garcia & Stallone in 1983 and later becoming a partner in 1993, where he remained until joining Kritzer Law Group. Over the course of his career, Mr. Zamurs has handled a wide variety of matters from inception to conclusion. He has obtained favorable verdicts for clients in matters involving dental malpractice, premises liability, legal malpractice, construction accidents, and motor vehicle accidents including favorable verdicts regarding the question of “serious injury”. During the course of his career, Mr. Zamurs has litigated a wide array of issues ranging from indemnification agreements, insurance coverage, Labor law 240(1) and 241 (6), and cases involving “serious injury” in motor vehicle accidents.
In addition, Mr. Zamurs has extensive experience in appellate matters. He has perfected and argued approximately 75 appeals. Among the most notable of his successfully argued appellate cases are; Balladares v. Southgate Owners Corp. involving the issue of common law indemnification in construction accidents and Interstate Cigar v. Dynaire Corp. which involved the use of expert witnesses.
Mr. Zamurs is delighted to continue the work he started at Garcia & Stallone with Kritzer Law Group, finding it a natural progression in his career in insurance defense.
Rocco Iervasi, Associate Attorney
Mr. Iervasi received his Juris Doctor degree from Hofstra University in 2016 He was admitted to practice in the State of New York in October 2016 and in the Eastern District of New York in 2022. Mr. Iervasi began his career as Staff Counsel to Geico Insurance Company where he handled a caseload in excess of 100 active auto liability defense matters. In 2019 he joined the firm of James F. Butler & Associates as staff counsel to State Farm Insurance Company, where he handled matters involving auto liability, premises liability and general negligence matters. He remained with James F. Butler & Associates until joining Kritzer Law Group in 2022. Over the course of his career, Mr. Iervasi has handled a wide variety of matters from inception to conclusion. He has obtained favorable verdicts for clients in matters involving general liability, premises liability, and motor vehicle accidents including favorable verdicts regarding the question of "serious injury". Since joining Kritzer Law Group, Mr. Iervasi has focused his efforts in the defense of the New York City Transit Authority and the MTA handling cases involving Transit Authority buses, paratransit buses and claims involving Transit Authority facilities. He has obtained numerous favorable verdicts since joining the firm.
Adam Kahn, Associate Attorney
Adam Kahn joined Kritzer Law Group as an Associate Attorney in 2022. Adam specializes in the defense of personal injury actions with a concentration on motor vehicle accidents.
Adam was inspired to pursue a career as an attorney at a young age while watching his father practice law as a successful litigator. Prior to becoming an attorney and joining Kritzer Law Group, Adam attended the University at Albany where he earned his Bachelors of Arts degree in Sociology. He later attended Touro University Jacob D. Fuchsberg Law Center on a merit-based scholarship where he earned his Juris Doctorate in 2021 while graduating with honors. During his time at Touro Law Center he completed over 150 Pro-Bono hours advocating for indigent clients in bankruptcy proceedings where he provided advice to clients, prepared Chapter 7 Bankruptcy Petitions and participated in bankruptcy hearings.
During his time in law school and following graduation, Adam worked for personal injury firms assisting in the representation of plaintiffs in motor vehicle accidents, slip and falls, construction accidents, and real estate proceedings. During that time Adam gained invaluable knowledge which he continues to utilize today in defense of similar matters.
Michael J. Mutarelli, Associate Attorney
Michael J. Mutarelli was admitted to practice law in the State of New York in 2013. He began his legal career at the Cassisi Law Firm, P.C., where he handled a variety of plaintiff’s personal injury matters including automobile accidents, premises liability, New York Labor Law matters, construction cases, dog bites, dram shop litigation, along with a collection of criminal matters.
Mr. Mutarelli switched to personal injury defense litigation in 2017 when he joined the law firm of James G. Bilello & Associates. While there, Mr. Mutarelli litigated numerous automobile accident cases to trial including those involving personal injuries and property damage. Mr. Mutarelli would continue his personal injury defense work in 2023 when he joined Kritzer Law Group where he handles a variety of defense matters including automobile and premises liability cases as well as defending cases against the New York City Transit Authority.
Mr. Mutarelli received a Bachelor of Science Degree in History from the State University of New York at Albany in 2008 and a Juris Doctor degree from Touro University Jacob D. Fuchsberg Law Center in 2012. Mr. Mutarelli’s hobbies include hiking, scuba diving, and home-brewing beer.
